Terms of Use Agreement

Your Relationship with AirbnSki

Your use of AirbnSki's products, software, services, website, and any mobile applications (collectively, the "Services") is subject to the terms of this Terms of Use Agreement (this "Agreement"). By using the Services, you agree to and are subject to the following terms and conditions, as well as our Privacy Policy, which is incorporated by reference (collectively, the "Terms").

AirbnSki is Only a Venue

AirbnSki acts as a venue for users of the Services as renters ("Renters") and owners of aquatic equipment or vessels ("Members") (Members and Renters, each a "User" and together,"Users") to view and post available rentals to facilitate transactions. AirbnSki is not a party to any actual agreement or transaction between Renters and Members, even though we may from time to time provide tools that relate to a booking, such as a tool to enable a Renter to enter into a transaction to rent a specific vessel or equipment directly from a Member and payment services to facilitate the booking.

Release and Indemnity

IN THE EVENT OF A DISPUTE BETWEEN A RENTER AND A MEMBER, MEMBER AND RENTER, JOINTLY AND SEVERALLY AGREE TO INDEMNIFY, RELEASE, DEFEND, AND HOLD HARMLESS AIRBNSKI AND ITS DIRECTORS, OFFICERS, AGENTS, AND EMPLOYEES (COLLECTIVELY, THE"AIRBNSKI PARTIES") FROM ANY CLAIMS, CAUSES OF ACTION, DEMANDS, RECOVERIES, LOSSES, DAMAGES (ACTUAL AND CONSEQUENTIAL), FINES, PENALTIES, AND OTHER COSTS OR EXPENSES OF ANY KIND, INCLUDING BUT NOT LIMITED TO REASONABLE LEGAL AND ACCOUNTING FEES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.

Your Use of Services

• You are responsible for ensuring compliance with legal and safety requirements when operating or renting equipment or vessels.
• You possess the legal authority to create binding obligations.
• You will use the Services only for lawful purposes.

Payment Services

As a Renter, you are responsible for creating an account, authorizing payments for bookings, and paying for services according to these Terms. To complete a booking, you must provide all requested payment details, including a valid credit or debit card, which will be used for pre-authorizations, deposits, and final payments.

Cancellation and Refund Policy

• Flexible policy: 100% refund if canceled more than 24 hours before the rental start time.
• Moderate policy: 100% refund if canceled more than 7 days before the rental start time.
• Strict policy: 75% refund if canceled more than 7 days before the rental start time.

Limitation of Liability

AirbnSki's liability is limited to the maximum extent permitted by law. Specifically: AirbnSki is not liable for direct, indirect, incidental, or consequential damages arising from the use of its platform.

Entire Agreement

These terms constitute the entire agreement between you and AirbnSki regarding your use of the platform and supersede all prior agreements, whether written or oral.
